OBJECT

The terms and conditions contained in these General Conditions of Use (hereinafter also, Conditions or General Conditions), constitute the general conditions regulating access to and use of the Sites owned and operated by Digital Plus Advertising. In addition, these Terms and Conditions are supplemented by the Privacy Policy.

The use of any of the Digital Plus Advertising Sites implies full acceptance of each and every one of the General Conditions contained herein.

Access to the Digital Plus Advertising Sites implies that the User acquires a series of rights and obligations, in order to ensure the proper enjoyment of the general services and content found therein and that Digital Plus Advertising makes available to the User.

The User is aware that the access and use of the services and contents of the Sites is done under his sole and exclusive responsibility.

User status is acquired by accessing the Sites.

The completion of the registration form is not mandatory to access and enjoy the services offered on the Sites, with the exception of certain services.

SECURITY POLICIES

WEBSITE

We take all reasonable measures and precautions to protect your personal information and follow industry best practices to ensure that your information is not inappropriately used, altered or destroyed.

We encrypt your credit card information using Secure Sockets Layer (SSL) technology, and store it with AES-256 encryption. Also, we follow all PCI-DSS requirements.

PAYMENTS

The payment methods used by THE COMPANY are third party services. These third party services (AZUL), comply with all security and encryption standards to keep your information secure. They will only use the information necessary to complete the required process. We also recommend reading the Privacy Policies of these providers, to better understand how they handle the information provided.

USER REGISTRATION

For the access and/or use of certain services of the Sites, under registration, the User must assign a User name/s, as well as a password/s, committing to make a diligent use of both (User name and password) and to maintain the secrecy of the credentials and passwords, thus answering for all the damages of the incorrect and negligent use of the same.

At any time, and without prior notice, Digital Plus Advertising may deny or withdraw your use of our Sites when you violate the Terms or the Privacy Policy.

MINORS

Children under the age of 18 may not use Digital Plus Advertising Services that require registration or identification as a registered user of the Sites, even with the representation of their parent, guardian or legal representative.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All information contained in the Sites including, but not limited to, databases, graphic design, photographs, logos, trademarks, images, audio, video, documents, source code and any content published on the Sites, constitutes a work whose intellectual and industrial property belongs to Digital Plus Advertising, or to third parties without it being understood that the use or access to the Sites and/or the services offered therein attributes to the User any right over its ownership.

The User shall refrain from reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the services, unless authorized by Digital Plus Advertising or the third party holder of the right; delete, evade or manipulate any data or sign identifying the rights of Digital Plus Advertising or its owners incorporated into the services as well as technical protection devices, and in particular, use the information of any kind obtained through the Digital Plus Advertising Site or services, to send advertising, communications for direct marketing purposes or any other commercial purpose, send unsolicited messages addressed to a number of people regardless of their purpose, as well as to refrain from marketing or disclosing in any way such information; obtain any image, recording, software and, in general, any kind of material accessible through the Site by any means other than those made available to Users by Digital Plus Advertising.

CORRECT USE OF THE SITES

Any User who accesses the Digital Plus Advertising Site agrees to the correct use of all services found therein, in accordance with the provisions of the applicable legislation in force and the contents of the General Conditions published on the Site at all times for each service, refraining from any act that could go against the interests of third parties and the structure and operation of the Digital Plus Advertising Site.

Specifically, the User may access the contents and services of the Sites available as such free of charge and without the need for prior authorization, without prejudice to the technical conditions or the need for prior registration with respect to specific services and contents, as determined in these general conditions of such services.

Under no circumstances may the User:

• Access or use the services and contents of the site for illegal purposes, harmful to the rights and freedoms of others, or that may damage, harm or impede in any way, access to them, to the detriment of Digital Plus Advertising or third parties or contrary to the legal conditions published on the Sites.
• Use the services, in whole or in part, to promote, sell, hire, disseminate advertising or information of their own or third parties without prior written authorization from Digital Plus Advertising.

• Include on the Sites of your responsibility or property "metatags" corresponding to trademarks, trade names or distinctive signs owned by Digital Plus Advertising or third parties.
• Reproduce all or part of the Digital Plus Advertising Sites on another website; you may not frame the Sites accessible through this website in any way that conceals or modifies, but is not limited to, content, advertising space and trademarks of Digital Plus Advertising or third parties, whether or not it involves acts of unfair competition or confusion.

Digital Plus Advertising reserves the following rights:

• Modify the conditions of access to the Sites, technical or otherwise, unilaterally and without notice to users.
• Limit, exclude or condition the access of the users when not all the guarantees of correct use of the site by them are given in accordance with the obligations and prohibitions assumed by them.
• Terminate the provision of a service or supply of content, in any case, and in particular, when the same is unlawful or contrary to the conditions established for the same.
• Take any legal or judicial action that may be appropriate for the protection of Digital Plus Advertising's rights.
• Demand compensation that may arise from the improper or unlawful use of all or part of the services and content provided through the Sites.

PROTECTION OF PERSONAL DATA

Digital Plus Advertising guarantees the confidentiality of personal data provided by users through the Digital Plus Advertising Sites and, in particular, for the subscription and use of the content published on the Sites, and its treatment, in accordance with current legislation on the protection of personal data.

PRICES AND PAYMENT METHODS

All our services are quoted in US dollars.

PRICES AND LIQUIDATION

With respect to the prices of the services, the customer will be charged the prices established in the corresponding section, as offered on the website. The prices include the tax on transfer of industrialized goods and services as provided by the applicable laws in Dominican Republic (18%).

In addition to the purchase price, customer shall be responsible for all taxes, including transfer, excise, use, privilege, ad valorem, customs and any other similar taxes, levies, fees or charges, imposed or increased by virtue of any municipal, state, federal, international or any other nation's law, rule, ordinance or regulation with respect to the services sold to customer. In the event Seller shall, for any cause whatsoever, become obligated to pay such taxes, Buyer shall, upon request, immediately reimburse Seller for such amounts. Customer shall provide, upon Seller's request, any tax exemption certificate.

In addition, to the extent required by applicable laws in each country, customers agree to send us duly completed tax forms to enable us to make all required filings with the tax authorities.

PRICE CHANGE

We may change prices and/or introduce new charges in addition to the prices at our sole discretion with thirty (30) days prior written notice to the User.

Notwithstanding the foregoing, we may increase prices, immediately and with contemporaneous notice.

PAYMENT

The price of the services shall be paid in advance by credit card or other payment method accepted on our website.

TERMS OF PAYMENT

To provide any service, it will be necessary to cover 100% of the amount including taxes.

PAYMENT METHODS

Payments may be made via accepted credit or debit card.

We are not responsible for delays in our services in cases of acts of God or force majeure. Under no circumstances will Digital Plus Advertising pay penalties for delays in the delivery of our services.

HYPER LINKS

The User who intends to include within its Web page any type of link, which involves a hyperlink to the Digital Plus Advertising Sites or any of the pages that compose it must comply with the following Conditions:

• No false, inaccurate or incorrect statements or indications shall be made about the Digital Plus Advertising Sites.
• The hyperlink will only allow access to the Digital Plus Advertising Sites and services, but may not reproduce them in any form.
• It shall not be stated or implied that Digital Plus Advertising has authorized the hyperlink or has supervised or assumed in any way the contents or services offered or made available on the website where the hyperlink is established.

RESPONSIBILITIES

Digital Plus Advertising is not responsible for the consequences of the User's failure to comply with the General Conditions of Use.

All services accessed through our Sites, including any action or the performance of any obligation and/or right between Users of the Sites and advertisers, are deemed to be between these two parties, Digital Plus Advertising being exempt from any liability whatsoever.

In the event of any liability of Digital Plus Advertising, Digital Plus Advertising shall only be liable for damages actually and directly caused by it, not including in any case compensation for loss of profits.

Our Sites may be discontinued or altered without notice and Digital Plus Advertising shall have no liability to the User or any third party for such action.

Digital Plus Advertising is not responsible for system malfunctions due to technical conditions or third party causes.

Digital Plus Advertising disclaims any responsibility for the services and content found both outside and within the Site, nor shall it be liable for damages of any kind arising from the lack of availability or continuity of the operation of the services offered on our Sites.

Digital Plus Advertising does not control everything contained within the Sites, and is not responsible for any damages that may arise from the existence of any virus or other element that may cause alterations in the computer system, nor for any damages that they may cause to the hardware or software of the Users.

In any case, Digital Plus Advertising will not be responsible for the information that provide links to other content or include in their own directories or search tools content, provided that Digital Plus Advertising has no actual knowledge that the information to which they refer is illegal or that injures property or rights of a third party liable for compensation and, if you have that knowledge, act diligently to remove or disable the corresponding link. Notwithstanding the foregoing, Digital Plus Advertising reserves the right to refuse or withdraw, at any time and without prior notice to those Users who manifestly perform illegal activities.

Digital Plus Advertising does not control or offer any kind of guarantee on the identity of the Users, nor on the veracity, validity and authenticity of the data that the Users provide about themselves or about other Users; not being responsible for damages of any nature that may be due to the incorrect identity of the Users and the lack of veracity, validity and authenticity of the information that the Users provide about themselves or make accessible to other Users.

USE OF COOKIES

Digital Plus Advertising uses cookies and data storage and retrieval devices on the User's terminal equipment when the User browses the website.

SHIPPING AND DELIVERY

 As a customer you can choose from the following options Delivery in our store or home delivery. 

Orders received after 6:00pm will be processed the next business day.

 Home Delivery:

• At the moment of receiving the order, you must identify yourself by presenting your valid identification document. In case it is not you (the customer himself) who receives the product, you must authorize a third party to receive it, previously indicating on our website, the name and identification number of the person authorized to receive. The person receiving the product must sign the Conforming Receipt Form as a sign of acceptance.
• Home delivery service only applies in the cities of Santo Domingo, Santiago and Punta Cana.
• In the case of Appliances and Furniture, if you are not satisfied with the merchandise you must indicate the reason and sign the Receipt Receipt Receipt. The material will be returned to our store with the corresponding note and we will proceed according to our Returns and Exchanges Policies.
• It is your responsibility as a customer the accuracy of your data and address information entered; this is to make a correct and timely delivery of orders. These deliveries are made to the address indicated at the time of generating the order on our website; once processed, the delivery address cannot be changed.
• Home deliveries are made between Monday and Friday from 10:00 am to 5:00 pm. Deliveries will not be made on weekends or holidays.
• The goods are delivered on the FIRST LEVEL. The delivery service does not consider disassembling doors or windows, nor the use of ropes or any other element to lift the products to upper floors, nor the assembly. It is essential that before purchasing, you check the dimensions of the product and the place where you will install it, so you will avoid problems and the delivery can be made satisfactorily.
• Home deliveries of appliances and furniture will be made 3 to 5 working days after the purchase is made.
• Appliances that require installation are not the responsibility of the carrier and the carrier is not permitted to do so.
• Our shipping rates and related processes include the processing, handling and packaging of the order. The shipping fee is RD$250.00 for orders under RD$15,000.00; above this amount the shipping will be free of charge.
• For peak seasons (Black Friday, Christmas, Mother's Day, Midnight Sale) delivery commitments will be 5 to 14 business days.
• We will notify you upon arrival at the delivery address, which must be clearly indicated when you place your order in our system. If delivery is not possible, a second attempt will be made. If delivery is unsuccessful, your order will be returned to our store's warehouse where you will be able to pick it up. Appliances and furniture for the third attempt, we will contact you again to coordinate a future delivery. The delivery date must be within 15 business days after the order is placed. In the event that the 15 days are up, and we have not been able to deliver the order, we will cancel your order and refund your money by the same payment method used if possible.

Store delivery:

• The range of hours for Store Delivery orders is Monday through Sunday, between the hours of 8:00am and 8:00pm, with the exception of holidays.
• Appliances and furniture are exempt from Store Delivery. They will only be delivered to your home.
• The stipulated time to pick up your order will be two weeks from the reception of the order. Otherwise, we will proceed to cancel the order and refund the money by the same method of payment used if possible.
• Orders placed by 6:00 p.m., will be available for Next Day Store Delivery starting at 12:00 noon midday. Orders received after 6:00 p.m. will be delivered the following business day, starting at 3:00 p.m.
